State program for compensation for humanitarian demining of agricultural lands
The state program of compensation for humanitarian demining of agricultural (agricultural) lands is aimed at restoring the safe use of agricultural territories and supporting agricultural producers whose lands were damaged by explosives. The program is implemented at the expense of state funds, which allows to provide financial support to farmers in the restoration of agricultural lands.
Program goal
The goal of the program is to compensate farmers for the costs of humanitarian land demining, which allows these territories to be returned to safe use and to promote the restoration of economic activity in regions affected by explosive objects.
Requirements for participation in the cost compensation program for demining agricultural areas:
- the fact of contamination of the areas was confirmed by the Mine Action Center based on the results of non-technical inspection by certified operators;
- the agrarian is not under NSDC sanctions in accordance with the Law of Ukraine “On Sanctions”;
- the ultimate beneficiary of the producer is not a citizen of the aggressor state, a member of a terrorist organization, or a participant in a legal entity associated with terrorist organizations;
- the farmer has no tax debt (except for tax debt for land payment and single tax for payers of group IV) as of the 1st of the month preceding the submission of the application;
- the producer's enterprise is not in the process of bankruptcy, liquidation or cessation of activity;
- The farmer is not a related party to the certified mine action operator with whom the contract is concluded.
Compensation for the cost of services for demining agricultural areas for farmers who plan to demine their land - 100% of the cost of humanitarian demining.

Submitting an application
An agricultural producer applies for compensation through the State Agrarian Register (DAR): https://www.dar.gov.ua/.
The application process ends with an electronic signature. -
Application deadlines
Applications are accepted until December 25 of the current year. Applications submitted by December 5 will be considered in the current budget year. Others will be postponed to the next year. Applications will be considered in order of priority.
Compliance check and grounds for rejection
- Re-submission of an application for the same land plots is not allowed if compensation has already been received for their demining.
- The Center verifies the agricultural producer's compliance with the requirements using data from state registers, in particular the Unified State Register of Legal Entities, Individual Entrepreneurs and Public Organizations, the State Register of Real Property Rights to Real Estate and the State Land Cadastre. In addition, the Center sends a request to the State Tax Service for verification.
- Land suitability is checked according to data from the Mine Action Center regarding:
- contamination/probability of contamination with explosive objects,
- impossibility of demining land plots due to the unfavorable security situation.
Grounds for rejection of the application: - The land plot does not meet the established requirements.
- The manufacturer does not meet the established criteria.
- There is no information from the Mine Action Center on contamination/probable contamination of land based on the results of non-technical surveys.

4. Notification of application review results
The Center sends the producer a notification of acceptance or rejection of the application through the personal account in DAR and duplicates this notification to the farmer's email.5. Opening an escrow account
Within 5 business days after the application is approved, the farmer opens an escrow account for compensation (escrow account) at an authorized bank. The bank notifies the Center of the opening of the account within 2 business days.
6. The determination of the expected cost of purchasing services for demining agricultural land plots is carried out in accordance with the methodological recommendations for calculating the cost of humanitarian demining works, approved by the Ministry of Economy.
- The Center begins purchasing demining services within 3 business days after the farmer opens an escrow account.
- Procurement is carried out through public bidding in accordance with the requirements of the law.
- Based on the results of the procurement, the winner of the tender is determined, with whom a contract for the performance of humanitarian demining works is concluded.

The Center sends the producer a certified copy of the contract and informs about it in the DAR's personal electronic account.
7. Compensation financing - The Center opens registration accounts of the general and special fund of the state budget in the Treasury for the transfer of budget funds.

After receiving funds from the Center, authorized banks transfer them to the escrow accounts of commodity producers within three business days, of which the Center, agricultural commodity producers, and certified mine action operators are informed.
8. Carrying out demining work - The mine action operator begins work within 5 business days after receiving a notification from the bank about reserving the full amount of funds for the provision of demining services for agricultural areas of destination.
- After completion of demining, the PMD operator provides the Center with the necessary documents, including a copy of the territory clearance certificate or a letter of guarantee for the territory released according to the results of a non-technical survey.
- The center checks the documents and, after signing, sends their certified copies to the bank and the agrarian.
- Upon completion of demining and receipt of certified copies of documents, the bank transfers funds from the escrow account to the PMD operator's account.
Compensation for the cost of services for demining agricultural plots for farmers whose lands have already been demined - 80% of the cost of humanitarian demining.
Procedure for submitting applications for compensation for humanitarian demining of agricultural lands that have already been demined by certified mine action operators (MACOs) from February 24, 2022 to April 15, 2024

Submitting an application
The agricultural producer submits an application for compensation in electronic form to the Center's email address: compensation@uachd.gov.ua.

The application is signed with a qualified or advanced electronic signature in accordance with the legislation.
Documents attached to the application:
- A copy of the contract for the provision of services for the demining of agricultural land plots concluded with a certified mine action operator (MAPD);
- A copy of the primary accounting document (acts of services rendered) confirming the performance of humanitarian demining work;

A copy of the payment instruction or other document confirming the fact of making payments for demining by April 15, 2024.
Features of submitting an application by farmers who are certified by the APMD
Agricultural producers who are certified by the APMD and have independently demined their own or leased lands must additionally submit: - primary accounting documents, in particular the act of work performed;

cost calculation.
3. Application deadlines
- Applications are submitted by the 10th of each month. Applications received by the Center after the 10th will be considered the following month.
- Applications are accepted until November 15 and are considered on a first-come, first-served basis.
4. Compliance check
- The Center verifies the agricultural producer's compliance with the requirements using data from state registers, in particular the Unified State Register of Legal Entities, Individual Entrepreneurs and Public Organizations, the State Register of Real Property Rights to Real Estate and the State Land Cadastre. In addition, the Center sends a request to the State Tax Service for verification.
- Information on demining is verified within 5 working days based on data from the Mine Action Center.
5. Grounds for rejection of an application
- Land non-compliance with requirements;
- Lack of confirmation of completed work from the Mine Action Center;
- Non-compliance of the manufacturer with the requirements;

Lack of necessary copies of documents. The agricultural producer may resubmit such an application.
6. Review of applications and decision-making
- The Center forms a list of producers who are offered compensation and transfers it to the Ministry of Economy.
- The Commission for consideration of issues related to the provision of compensation for costs for humanitarian demining of agricultural lands, which is established by the Ministry of Economy (the Commission), considers applications by the 25th of each month and provides the Center with recommendations on providing compensation or refusal. The Center informs the agricultural producer about the proposals and recommendations provided by the Commission.

The Center makes decisions based on recommendations and forms a submission to the Ministry of Economy for the distribution of funds.
7. Providing compensation
- The Ministry of Economy distributes funds according to the budget program for their subsequent transfer by the Center to banks.
- Authorized banks, within 3 business days of receiving funds from the Center, transfer them to farmers to the accounts specified in the application.
